A basic guide to leaseholder rights and responsibilities

Introduction

Owning a leasehold flat or house comes with 3 key things:

  1. rights to protect you
  2. responsibilities for both you and your landlord
  3. rules in your lease that you must follow (sometimes known as "restrictions" or "covenants")

Understanding these 3 things will help ensure you:

  • know what you can and cannot do with your home
  • challenge unfair charges, fees and poor management
  • ensure your landlord (freeholder) or managing agent meets their responsibilities
  • do not break the rules in your lease, for example on subletting or alterations
  • protect the long-term value and saleability of your home
