Setting up the right to manage

Getting access to check the condition of the building

After serving the notice of claim, the right to manage company has the right to get access to inspect parts of the building that it needs to see, to help with taking on management.

The right is for anyone authorised to act for the right to manage company. This can be useful to arrange for a professional to see parts of the building that are not usually open to the leaseholders, such as plant rooms, lift motor rooms, communal boilers, the roof space, water tanks and electrical installations.

The right to manage company will need to know about the state of these parts of the building, to plan for any repairs or maintenance.

You need to write to the landlord and give at least 10 days’ notice. There is no prescribed wording for this letter.

The relevant legislation is Section 83 of the Commonhold and Leasehold Reform Act 2002.

The landlord also has a right to get access to flats in the building, with the same notice period.
