You can use a leaseholder deed of certificate to show your landlord that you qualify for leaseholder protections under the Building Safety Act 2022.
Qualifying leaseholders have certain protections from being charged for the costs of fixing historical safety defects on their buildings.
You can download the form from GOV.UK, and when you have completed it, you should send it to your landlord, keeping a copy for yourself.
On the form, you will have to say:
- whether you or the owner lived at the premises on 14 February 2022 as the only or principal home
- whether, if it was not your only or principal home, you or the owner owned more than two other properties in the UK (that is, you had more than three in total) on 14 February 2022
- the price paid on the last sale of the property in the UK before 14 February 2022
You will have to give evidence for your answers, namely:
- documents that show that it was your only or principal home at that date, such as a council tax, utilities bill or bank statement
- an official copy of the register of title at HM Land Registry showing the date of the last sale
