User FAQs
Under the terms of my lease the landlord is responsible for arranging buildings insurance, but he is failing to do so. What can we about this as leaseholders?
If your landlord fails to arrange the buildings insurance they will be in breach of the terms of the lease. You could take legal action against them through the County Court to seek an order for specific performance and/or damages. You can also seek to recover your costs.
You could also apply to the Leasehold Valuation Tribunal (LVT) for a manager to be appointed. Alternatively it may be possible to buy the freehold or exercise the right to manage (RTM).
